I just have a quick question. Legally how long does the government have to set a hearing date after you have filed for it? There must be some sort of time frame in which they must respond, right? :sigh: :blink: :shrug: :nono:

I don't know the legal time frame,but it took me over a year to get a court date. It was set for tomorrow.I applied for ssd over two years ago and was denied twice. I was approve today with the help of an attorney. I wish you the best!! :love:

Can't remember forsure how long it took. Filed the first time five years ago, right after the stroke and kept getting denied everytime(but didn't stop appealing everytime they denied it, that's very improtant). In Dec. 2003 filed for another hearing (and I think again in April 2004 can't remember forsure) and then finally got one in Sept 2004, but it had to be postphoned. Then Nov 8th, 2004 had the hearing and the day after Thanksgiving received a letter from the judge saying he found the case "Fully Favorable", now just waiting for the rest to take place. Didn't get a hearing though, until I go a lawyer, so now he'll get 25% of whatever I do get (if & when I get it), but that's still better than getting nothing at all, haven't have it before now anyways.

Hi Jamie - It took over over three years for me to get approved on SSDI - I was denied twice and then I got an attorney who applied for a hearing which took about eight or nine months to get the date. Once you apply for a hearing they will send you a letter telling you that you will receive a response within a period of time - I think its five months, and that letter will give you the date of the hearing. They do have some guidelines about contacting you and they stay within them but just barely. If they tell you they will conact you in five months, you will hear from them on the last week of the fourth month.

A SSDI attorney can give you a better guideline of their turnaround requirements.

I have a friend here in Georgia who has been waiting almost 2 years and they just told her that her court case is scheduled for next AUGUST!!!!!!!! That is rediculous. You wait forever and then have to wait more. Like I've said, I waited two years and when my file got to the hearing office, I called and got a lady to get a lawyer and a judge to look at my file and they approved me with an On The Record Decision. That is where they look at all that is in your file and they decide that they don't need any more info to prove to them that you are disabled. I was approved within a month, would have been sooner but first the lady went on vacation and then the lawyer went on vacation. So I had to wait till everyone was back in office.

I'm sorry that it is taking you so long. Its terrible that we have to jump through so many hoops for them. Its bad enough that we have this terrible illness. Did your lawyer say anything as to why its taking so long. I know they're backed up. What did he say?

It is a shame that it is taking so long. I have never seen in print how long before they must give you a hearing date. The only thing I see is when we must have our paper work in by. Not fair but this is the government.

There is also a loop whole - which I will be going for next week. It called presumed disabled. Hae to do all the research first

The amount of time is also dependant on the state you live in and the backlog. States with higher 1st or 2nd approval seem to get to see the judge quicker.

There isn't much more to tell. I e-mailed my congressman. Basically I am stuck.

What is presumed disabled? I have never heard that term.

The only thing that we have to go by is the social security's defination of disability which is:::

"DISABILITY UNDER SOCIAL SECURITY IS BASED ON YOUR INABILITY TO WORK. YOU WILL BE CONSIDERED DISABLED IF YOU CANNOT DO WORK YOU DID BEFORE AND WE DECIDE THAT YOU CANNOT ADJUST TO OTHER WORK BECAUSE OF YOUR MEDICAL CONDITION(S). YOUR DISABILITY ALSO MUST LAST OR BE EXPECTED TO LAST FOR AT LEAST A YEAR OR TO RESULT IN DEATH."

This is from the Social Security pamphlet, Disability Benefits that you get when you apply.

Good Luck Here, the congressman really helped me. I hope he or she does you too.

I leave in the state of Oregon and when I called SSD they said it would take 14 mo. from the date I appliedfor a hearing they said it just depends upon where you are on the list on how long it will take they said a 14 mo, waiting list is where it is now I sould have my hearing in March 2005 I appied in aug 2003 was denied twice then got a lawyer and we applied for a hearing.The wait has made me crazy :wacko: I had to put my home up for sale other wise I'm going to lose it and I have invisted a lot into are home. So if I where you I would plan on it taking up to two year .

I was denied twice,within 4mos. now its been almost a year and still waiting for my hearing date. I live in Mass. and when I asked why I didnt have a date yet, I was told it was because of long list of people also waiting and getting hearing dates. My lawyer couldnt do anything about that! I hope you dont have to wait much longer. Hugs....Joannemc

This is so super sad for very sick Disabled people (US!) and others!!! GOD HELP THIS PROCESS!!!! By the way,my attorney said that a person is considered disabled if they can not work 8 hours a day,40 hours a week. He said that part time is still considered disabled. I live in FLorida. GOD BLESS!! I was approved after the Judge reviewed my file/case. I didn't have to go to court! THANK GOD!! I just can't understand why the social security office could not approve me. They had the same file! :wacko:

That is great news. I still don't have a hearing date. :angry:

I did take my file (over 500+ pages) to my local congressman. I hope he helps me. It is encouraging to hear that you were approved.

It is degrading to go through all that. I mean it is bad enough you have ever aspect of your life ruined and then for me anyway this was a last resort. I don't won't it, but you have to have some help from somewhere.

I am tired of the whole thing. People surely have no idea what truely being disable is like.

I was told (today, in fact) that the social security office has 120 days to assign your case to a judge after you request a hearing. Then, the hearing is usually a year away.

I started my application process in April 2004. I got my second denial on November 2004. I requested my hearing November 22, 2004, so I should get a date this spring.

What does that term mean? I am not familar with it.

The congressman's office called today to let me know that it had been sent to a judge. So, hopefully we will at least get a date soon.

Boy, I am dreading all this. I wish it was behind me.

An OTR decision was put in place by the SSA to streamline its case load. :rolleyes: I had to submit a Dire need letter ect., But it still took a longggggggg time to be approved by OTR decsion. My prayes are with you and yours

I have been denied on my first claim ..twice and twice on my second claim in 2001 and the third denied both times and now in the hearing to be scheduled. I did not know how long or anything other than talking with the Lawyer who doesn't plan on dealing with my case until right before the day of the hearing. :wacko:

I called the social security office who started my claim this time and I asked my caseworker about the hearing. She told me, today, that there is a long list of people filing and the judge will get in as many as he can the first day. I asked how would I know when the hearing will be, and she said, it usually takes 12-16 months to be scheduled. The judge will decide when and then letters are mailed out to inform the person(s) applying for benefits. After that, you go to the hearing and state your case or your lawyer will do that for you. B) :cry: :erm:

Hey Jamie,

OTR or On The Record is a decision the judge can make before you get to the hearing. He or She looks at all of your file and if they think they have enough evidence to decide the outcome, they will make an On The Record Decision. I've only heard cases where these are favorable. Wendy Rene's was decided the day before her date before the judge(I think)also I have another friend whose was also decided the day before. Mine was decided when I called the hearing office and a nice lady let a judge and a lawyer look at my file. My lawyer said it would be another year but I was desperate so I got enough courage and just went for it. Within 3 weeks(??)mine was approved. I had to wait till lawyer got back from vacation and then the lady went on vacation. You will get a letter telling you when your file has arrived at the hearing office.

GOOD LUCK, Hopefully you won't have to wait much longer.

This is a very interesting thread.

I have a friend who worked for the SSA for years, but quit about 10 years ago. He said he used to get irritated because when a Congressman got involved the client's case got moved through the system much faster, pushing others back.

He also said he truly tried to help the client get the disability, but they were so busy they couldn't take too long on each case.

Personally, the congressman has not helped move my case through because I still haven't heard anything.

Second, obviously you need someone on your side because the system is flawed.

Third, if you are an American citizen applying for US disability, you have the right to have a congressman get involved. Anyone, not just a select few, has this opportunity and right. There becomes an unreasonable point when you need anyone's help you can get.

They have had my appeal for ABOUT 8 MONTHS!!! Is this due process? I think not. And I have been sick for 5 years, tried everything to avoid disability and trying to get it for almost two years.

If he felt overloaded and backlogged, perhaps he should try to take action by contacting his congressman or woman for that matter and lobby to have more employees or wasy to expediate cases. Personally, there is no need for my case to have gone this far. It could have saved a lot of expense, time and effort had they simply approved it the first time as it should have been.

So, we must fight for everything it seems and it ticks me off that when I have no recourse and am not even well enough to fight but forced to for my family that someone standing from the outside feels that they have the right to judge my actions.

Perhaps that person should contract a chronic illness, have everything taken from them and then go through the system and see how they feel. You do what you have to do.

And, it is no more than what any other US citizen having trouble with their government has a right to do!

Hi Jamie - I agree that your attorney should be bugging them for some answers about when to expect and answer or at least a date. And keep writing to the elected officials, you can email them also asking for a confirmation response of your correspondance.

Or send certified return receipt to their offices. Heck, I did that about an Arizona Film Making bill and got a return e-mail from my state representative so you should definately pursue this!! I know it seems like drudgery at this point but sometimes its just the mechanics of what we have to do to get the end result that matters.

I was not defending the system, as I, too, think it's really flawed. I was just saying that there are good people in a flawed system. My friend is one of the most sympathetic, kind people I know. He worked for the SSA for most of his life.

I am so sorry you are having such a difficult time. I'm just beginning my social security journey, so I have that frustration ahead of me.

I personally think that if the politicians had to go through what we have to, there would be some huge changes in the system. You-know-where may be frozen over when that happens!!

Yes, suppose I do need to write back my congressman. My attorney is useless and almost takes an attitude when I call to check on things like somehow I work for him instead of him working for me. I am really disappointed in my attorney. Wish I had hired someone else.

He was reccommended to my husband and was suppose to specialize in ssd. He is useless and I really can't see what he has done beyond signing his name to a few papers.

Hi everybody, just catching up. I recieved my denial letter for ssd this week. I called an lawyer who said I had to be turned down more than once. He said to ask for reconsideration and when I'm turned down again then give him a call. I thought, right now his fee ia 25% of nothing, but if it get dragged out for 2 or 3 years then what a fee that would be.

I don't understand this proccess. I'm in Georgia and it sounds like (1) Georgia has a lower rate of approvals for ssd than the national average. (2) That there is a bigger reason for dragging out the proccess in the first place.

I geuss I'm mad. Too many years with Lupus. Starting to run out of steam.

There is a cap on the amount they are allowed to collect. So, after that point is is not to their benefit to drag it out any longer.

There is a cap as 'here' said. The lawyer gets 25% of your backpay BUT he can only get MAXIMUM of 5300 dollars. I heard it is now 5400 but don't know for sure. So, if it does take you years and you get lots of backpay, he only gets 5300 dollars.

Hello friend, sorry not been online much lately....

hey, I heard that here in KY it only takes 6 months to get in front of the judge. I also have my senator and congressman working on it as well. I have never heard of the On the record thing but hey, if I ever get my date, maybe I can try it too.

I was told in my last denial letter that they admit I have these dreaded diseases...lupus, sjogrens, svt's, colitis, diverticulitis, etc, etc., but that they find I am able to work since I have all these wonderful things , and I quote "within normal limits" which means I am not affected by them. Bull hockey....let them try to get out of bed those bad days.

Anyhoo, to tell you some interesting facts, a friend works for a ss attorney and she told me these things to get BEFORE your hearing...

1. letters from previous employer (s) who can attest to your absenteeism.
2. Letters from friends who have seen firsthand the effects the disease has on you for example, the extreme fatigue, inability to function, etc. She said use for them to use those exact words in their letters (if it is true to your case).
3. Bring your medication lists and the papers the pharmacist gives you regarding side effects of those meds (the ones I used to throw away every time)and highlight the side effects that you have from taking the meds.
4. Bring your entire medical history with you and highlight the pages and entries where you meet the guidelines for ss disability.
5. Bring your mate or a frined with you to the hearing so they can attest in person about your disease and how it affects you.

She said these things really do help and the judge will listen. Also enlist all your elected officials to help you. That is their job. They are paid huge sums of money to be elceted reps so make them earn it!

Jamie - I hope that your attorney will surprise you. Sometimes it seems like they're not doing anything (I've had to hire one for custody issues) but they can't speed up the judicial system. I think there should be a law put in place for hearing these cases in a timely fashion. This issue really angers me.

Anyway, I hope things start rolling for you, Jamie.

Perhaps if I had been dishonest, lied or tried to cheat the system I would have been approved on the first go-around?! :lol:

Give-up for just trying to survive!

This is beyond reasonable!!!!!!!!!!

What if I had taken this long to pay my taxes or respond to them? Would that have been allowed in our system?

hmmmm ;)

Oh well, at least I feel better complaining here a little... How much longer will it take to get an approval?

Where I'm at the usual wait for and appointment for the hearing is 12-18 months! I filed nearlu 2.5 years ago, was denied twice, got a lawyer and am now waiting for my hearing. I applied for the hearing Oct'04. I think that my area has the longest wait.

It's been a while since I have posted anything in here. Just wanted to let you know that I was denied again, and again, and now waiting for a hearing date. It has not been scheduled, yet, but the judge does have my medical records, etc., to make an on the record decision. How long that will take, I do not know. :unsure: I filed for a hearing date in February 2005, and it's taken this long for the judge to get my files. :angry: :goodvibes:

I asked for help from the senators of my state and they have gotten the judge to pull my files and make an on the record decision. If he feels there is not enough evidence, then I will still have an opportunity for a hearing. If he decides there is plenty of evidence then he will make the decision and inform the senators and me. They are keeping me informed via email. :D

I started applying in 1999 and still waiting for approval. Hopefully it will come out in my favor this time. :woohoo:

Well I got a letter today from SSD. What a joke. I am so sick of this. I have been waiting for a hearing for an unGodly amount of time. I have done everything I can to expedite things and today I get this &*%$ letter telling me that they will schedule a "consultative examination." What a crock! Here I am waiting for a hearing date and now I will have to wait even longer and go through another examination. I just am breaking down crying. I can't keep going through this c*#p! It is rediculous. It is hard enough having to deal with all the other stuff life throws at you without people making it even harder.

Perhaps if I had a strained muscle or was faking it, I would be approved right away?

I am sorry to sound so sarcastic and down, but gee... how much evidence do they need? Let see I take 13 different medications... not pills.. medications... I see nine different specialist and everyday I wake up hoping to just not have a problem with my brain, bowels or blood vessels. I have been dx with a list that won't even fit on their form of problems... I mean this STINKS!!!

I hate dealing with it all and try to do my best. I don't want this dang SSD, but I need it... my family needs it...

Will it ever end?

I am so sorry you are still going thru this... Haven' you already had a CE?? I would write congressman at www.congress.org and get the ball rolling. I really think they helped me...if you want to email me, I can email you a copy of what I sent them. I had a lawyer like yours too that didn't do much of anything. I seemed to do all the leg work. Have you called the soc sec office?

If you've already had a CE done, ask why you need another one and would it speed up things. I sent the letter to the congressman on June 22,2003 thru the website...My file got to the hearing office in August and I called and got lawyer and judge to look at it and got and On The Record decision at the end of August 2003.

I don't know why the lawyers don't do anything..I guess they think they're gonna get the money anyway so why do anything... I would call mine, email mine and never hear back anything.. For every 20 times I called, emailed him I might have got 1 call back.

Has your docs sent letters saying how bad your health was and the prognosis..My rheumy put Fair/Guarded on the last file she sent...Did you have the Functional Capacity Evaluation done by rheumy?

If you haven't yet.....PLEASE write your congressman at www.congress.org...Its very easy..all you do is put in your zip code and it will bring up who is yours and you write out the letter and it automatically goes to them plus the president. Like I have said many times on here..I think mine helped plus me calling the hearing office.

I hate that you have been waiting this long. I know how you feel, I have been there and is so heartbreaking knowing that you need the money so bad and are so sick and they just drag their feet.

I have written 2 congressmen. My representative has supposeably been helping me since January and recently I asked that one of my State Senators get involved too and this is what I got!

Yes, I have been evaluated by their doctors before... I feel like giving up... I just don't have that option :(

I originally filed in November 2004, have been deined twice now. I got an attorney after first denial and the request for reconsideration came within 60 days as denied. My atty told me in Ohio, waiting period for hearing can take up to one year from request of hearing. Just depends on waiting list. Good luck! Good for you taking your file to a congressman, sure hope it helps.

Here, I have some advice, for what it's worth. Have a neuropsych test done privately, rather than have theirs. They do a very short one that does not encompass nearly what a private one will. It doesn't catch as much either.

My private one has cost me $95 with insurance. There was a total of 7 hours, counting intake. The SSA one would have been 3.

You can't have both done, as that would invalidate the repeat test.

This advice self-destructs if what you meant was a mental health exam... :blink:

If what you are asking is did I apply on the basis of a mental condition., the answer is no. I applied because of many mutiple physical conditions that limit my capacitiy to work due to a multitude of various diseases that I have.

I quess I worded that one wrong. I applied on the basis of SLE, Fibro, Chron's, Chronic Lymphedema, Sjogrens, several arthrisises and depression.

I was approved on SLE, Sjogrens and depression. Once they saw the depression they became fixated on it. I was wondering if this happened to you.

To those of you who have filed for social security disability and have been denied time and after time, please don't give up. I know how hard it is to tell someone what is going on with you and then to have them tell you you do not qualify for disability under their rules.

I, too, have been trying for so long. I gave up on the first two claims due to reasons beyond my control, but this third one I can keep on and on. I have contacted my two senators and they are both involved in keeping my informed about my case status.

I received word the other day that my case was ready to be worked up and assigned to a senior case judge and then they will be informing soon as to what the judge's decisions are based on what medical evidence he has. So, far I have not heard anything else, this month. That's the best news I have heard since I filed for hearing date in Feb. 2005.

I will let you all know as soon as I hear what the results are. Hang in there and maybe the slow turning wheels of justice will be on both our sides.

O.K. just an update.. phychologist was nice.. things went o.k. I suppose.. really have no idea.

I got notice today that my hearing will be Nov. 17. Hopefully they will approve and all will end.

Can you believe my hearing is next week? Hopefully it will all come to an end. I am quite nervious and trying not to think about it.. Can you all your prays for a good outcome.

I do not know how i missed all your post about the dissabilty i am sorry first of all. I ahve been having alot going on in this we little head of mine sorry.It does say here in illinois it takes 120 days to find out wehter youg et it or not. You have been through h-l and back. I am so sorry for you. I think you will b ehearing porbably in the next month if they are like illinois andmaybe you can call the dissabily office and asl them how long it takes them ussually to figure this out. Just an idea and i know how you feel about these people. I cannot believe this lawyer you ahve. He so deseerves nothing he is doing nothing sorry just my feelings. I am still hoping and prayin gfro you and i will bewatching your post to here finally. Take care. You know that we all care about you in here very much so. Thanks for your prays. Yes it has been a long road. I think I orginally filed my first paperwork in November of 2003! And actually by the laws standards couldn't have filed way before that.. like many years.. but I was stubborn and did not want to file.. I kept thinking I would overcome and things would go back to normal.

Just filing the first paperwork was very difficult for me. I will be glad when all of this is behind me.
