Hi I was wondring if somebody can give me some advice I have been working for a well know store, were I used to work on checkouts but then i was started to struggle as i was always trired and in pain, i was moved departments but that meant i was always standing and the pain in my legs got worse. My managers moved me to yet another department which was 4 minutes walk away from orignal store. Over here you could take brakes at your own time I could rest when needed i found I was less tired her. Recently I got suspended for no fault of my own after investigations and interviews i was allowed back to work but they said I have to come back to store. I have tried to talk to them without any luck I am currently on sick leave. My consultant has also wrote to them but they say they will put me on checkouts. I can not work on anyother departments what can I do.

Advice will likely be contingent on what country live in... since this sounds like it will rapidly become a legal matter. Please write back with that bit of information and I'm sure others will be along with some good advice for you!

One suggestion I have for now is to ask for some modifications if possible - like can you sit in a chair while checking out or must you stand? Most countries will require accommodations that are reasonable be granted to keep a person working.

yes, if you are in the US you can ask for a 'reasonable accommodation' under the ADA act.
i do this for my job (make those requests for disabled people) if you need more info.
sometimes i find when it's not taken seriously, a written request can be better.

no im in the uk i am allowed to sit but i have sle and rsd meaning both my arm are very weak. it was them who sent me to anothr department and them who are bringing me back. when I actually said to them you are not accomadating my medical needs my people manger said so what.

Do you have a human relations department were you work? If you do than try going through them for some help. If you get nowhere with that is does sound like a legal matter and it sounds like you will need to speak with an attorney very soon. They have to make reasonable adjustments if they are not going to move you to a department that would be better to your health. Hello Naz, Are you a Member of a Union? If so please involve them immediately and I suggest you ask for the current situation to be confirmed in writing. (including the fact that they know of your needs and won't meet them. )

A friend of mine was recently sacked from a very large retail chain for sickness. He had been very trusting and not involved the Union until way too late. He then decided he could not face an appeal.

When you say you cannot manage checkouts I am not surprised. The one time I took my own shopping to a Self Service checkout it nearly killed both my arms and my brain!

Hey. This sucks! Go to the CAB (citizens advice bureau) right away. there is one in pretty much every town/city. You can find yours on their website if you google them. They are really helpful and will give you all the advise you need about your rights and how to go about dealing with your idiot bosses! xxxxxxxxx

Sorry to hear you're having so many problems with work. Have you tried asking your dr to arrange an Occupational health advisor to speak to you. They give you loads of help on what help you should be getting from work. Frightened my personnel dept to death but they've been fantastically accommodating since! If your employers don't take any notice of the adjustments asked for by you then I was told that the occupational health team will take over the case for you and basically make them. Hope this helps. Sorry you have to deal with this. Having RSD in itself is so painful I can not imagine working with it. Maybe you should think about applying for disability. It sounds like your just suffering.

This hits home for me as I was forced out of my job due to the company failing to accommodate me and my disability. I filed suit and just won last year but I often wonder if they would have helped me then possibly I would still be working. One will never know.

I do think your request should always be in writing so you have a paper trail to cover your butt. Also, not sure about your laws in the UK but here in the US it is legal to tape record someone when your speaking to them as long as it is a one on one conversation.

I walked around for over 3 years with a tape recorder shoved down my blouse and I hit record any time I knew I had to talk with my boss or someone else that I knew would be down right nasty to me all because I had a disability.

Thank God I did this as it really helped me win my suit. It never even went to court as my evidence against them was enormous. I wish you luck moving forward and I am sorry your dealing with this. It is heartbreaking for me to hear of another human being dealing with a employers nonsense and lack of commpassion.

Hold your head high my friend and if possible consult with some legal advice.

i guy's thanks for your help i spoke to my union they said i had to write to work first then see what there replay is, I wrote to the store manager told him how the people manager and other managers were treating me. Got a letter today from mu people manager saying they recieved my letter and as soon as my sick note ends they will discuss the matter. I have phoned work and informed them i will be comming back on the 7th of April 2009 but who is it i see and which department will you send me to just been come in on the 7th. I'm know very scared as they are not giving me information on were they will put me im worried I go in on tuesday and they put me on a department that causes pain.

Hi Naz,

You have to wait and see where they place you upon your return to work but if for any reason you can not do the job then I think you should discuss this with your union rep ASAP.

If necessary get a note detailing what restrictions or accommadations you need in order to be able to continue working.

Keep us posted and good luck upon your return on April 7th.

Hopefully they will give you a job that you can do with ease.:wink2:

first time im feel cheated why have i got this condition, im due back to work this week i dont think i will be able to cope with the pain. But it is final im going on a department that will aggravate my condition.

I am sorry they are putting you in a department that is only going to make things worse for you.:(

That makes a person :mad:. Office politics are the worse thing to have to deal with.

Sorry to hear you are in so much pain today Naz. Warming your hands with a heating pad or hot water bottle will help get your circulation going better and might lessen your pain. Try wearing some warm gloves also.

Years ago when my daughter was ill with something else she was taught biofeedback. Basically she learned to relax using images of things she enjoyed and slow controlled breathing. Not only was she able to release tension lessening pain she was able to increase her body temperature in her extremities. It might be worth a try.
