hi Clare
my problem with my Job is.i add a flare[celebrities]and i was in hospital.and Dr Cruz.from the lupus clinic.sign me off for 4 weeks.and i ask my firm if i could change my shift from nights[12 hours]to days.now they are sending me to a occupational health.but all i wanted to do is change my shift form nights to days.because when i am on nights.i am awake between 16-18 hours.and i get very very fatigue.and i do not get much sleep.
does any one know what my legal rights are?and what my firm can do once they get the report back from.occupational health?i have try the union.back they have not got back in touch with me.and need some advice because the appointment is for the 5/1/09.so any advice would be gratefully exacted.
PS
after the doctor sign me off for 4 weeks.i was sign off for 3 more weeks because.i had a lung and chest infection[so got it]

Hi tabsboy - your rights at work could depend on how long you've been working for them. Everyone can request different working patterns but an employer is not legally bound to give you the working pattern you want. Your request can be strengthened by occupational health who may recommend certain working hours. There are laws surrounding the Disabilities Act - if you go to a citizens advice bureau they will give you employment advice for free and tell you what your rights are with regard to working hours/patterns. All employers are supposed to try and make it possible for people to remain working. I know when I spoke to occupational health about my own circumstances, they registered me as having a chronic illness which means my employers have to give me reasonable time off for hospital/dr appointments and consider requests for fewer hours etc if I need it rather than end up being signed off sick. So far I haven't needed to use it as my employers are great and I can arrange my diary to suit what I can do, including working from home at times.

Don't worry many people find it confusing at first.

To post a new thread first decide which section you wish to post in and open it up by clicking on the name of the section.

When you click on this a message form comes up. Fill in the title area with a title that indicates the precise topic of your post not some general title When you have written your text scroll down to see 'Submit New Thread'
Hit that to send your post.
