I tried to get disability once and I was denied, one because my doctor doesn't think I need to be on disability. She was the one when I was diagnosed with lupus said you wanted to go on disability. I knew nothing of it so I said no then when I recieved enough information my doctor said no to disability for me. I am now struggling to just go to my doctors, had a few job offers but turned down. It's hard, you get depressed. I was told that lupus is not considered a disability. What should I do?

If you were recently denied disability and you are within the appeal time limit still, then you will want to file an appeal. If too much time has passed since you were denied then you will want to file a new claim. There are many helpful tips on this website in the "stickies" at the top of this forum that you may want to read. Many people will get a lawyer to help them file the paperwork especially after the first denial.

If you need to file again with a new claim then it is important to appeal after any denial immediately.

If your doctor does not support you in your decision to seek disability then you may want to try to find another doctor; at least ask her why she feels that you no longer need it when she thought you should go for it when you were first diagnosed and then try to explain to her why you feel you need it now. See if she can be convinced... and if she can't then you may want to find another doctor who is more supportive.

If depression/psychiatric problems are also a problem for you as a consequence of lupus or in their own right, then that should actually help you get SS disability. Unfortunately, it usually does take a while to get onto SSD even with lupus and depression. That is why you have to keep at it until you get it.

Maia gave you great advice. I am on SSD and everything she said is 100% accurate.

I wish you luck and press forward with this. I am curious are there any doctors that agree you should be on SSD?

If so, you may want to ask them to write a letter on your behalf.

It helped my case a lot.

I am very sorry for your difficult situation and can't add to what has been said because I am not so familiar with US systems. But from reading posts here I am pretty sure that one thing is the same as in the UK. It doesn't have much to do with the name of your diagnosis it has to do with your ability to work whatever the reason.
So the woman who commented that lupus doesn't count as a disability is wrong in this context. Of course if lupus was a recognised disease like MS I am sure it would make things easier, especially if it was named as a disease for Disability Discrimination legislature.

Hi I was also denied once but I got an Attorney who helped me with this, and Today I just found out that I was excepted. It has been almost 2 years for me, but I didn't give up and now it's paid off:) Please don't give up, it's really worth it, I haven't had an income in a few years and know what it's like. My husband's money goes for what we can pay & childsupport ($2300 mo.) so we're really broke. It's been really hard on me with the stress of everyday, not being able to help him out with the bills, and all, but now we're going to do fine.

One thing I would like to add is that you see someone for depression, it really helps me, and I know they're doctors out there that will work with you too. When it all came down to it, my depression played a big part in this. I at first didn't want to see anyone for it, but I had to, as I was very depressed all the time. I still am, but I think it's getting better. Please keep in touch with me, and let me know how you're doing.

Hi,

Lupus is a disability. You need to get a doc on board with your decision. Depression is also a disability. Are you seeing a shrink? What is the shrinks reply? If you do not have one get one.

Lupus is so different for every person, Do what you feel is right and the more they tell you no the more you have to stand up for yourself i learned that after 15 years with lupus,work,doctors,ss,friends,family, and list could go on forever. Do what you have to, to get what you need.
